A group founded by former Gov. Jeb Bush issued a statement Thursday praising a court ruling that upheld the constitutionality of a law allowing the State Board of Education to overturn local denials of charter-school applications.
The ruling by the 4th District Court of Appeal came Wednesday in a case involving the Palm Beach County School Board’s decision to reject a charter-school application. The State Board of Education overturned that decision — leading to a constitutional challenge by the Palm Beach board.
The Bush-started Foundation for Excellence in Education, which is a major backer of school-choice programs, had filed a friend-of-the-court brief backing the State Board of Education’s authority.
“Charter schools play an important role in Florida’s school choice landscape, providing high quality educational options for more than 270,000 students and their parents,” the group said in the statement Thursday. “We commend Florida’s 4th District Court of Appeal for ensuring that the Florida State Board of Education has the authority to continue to review appeals from charter school operators denied approval at the local level.”
